READ THIS AGREEMENT CAREFULLY BEFORE USING ANY CYNET STUDIO SERVICE.

"We" includes CynetStudio.com or any party acting on CynetStudio.com's implicit instructions. "You" includes the person purchasing the services or any party acting on the customer's instructions. "The Registrant" includes the person applying for a domain name or any party acting on the Registrant's instructions. "The Registry" means the relevant domain names Registry.

1.0 Shared Hosting & Email Services

• 1.1 Cynet Studio do not own any data including database, applications, web and e-mail that are hosted in our server. Therefore, we do not have the right to remove or modify customers data unless an abuse complaint is sent.
• 1.2 You shall be responsible for regulary making back-up files in connection with the use of the services by yourself. We do back-up your site weekly, however, we do not guarantee the existence, accuracy, or regularity of its backup. Cynet Studio are not liable of any damages and losses caused by hardware failure, natural disaster or foulplay at the datacenter.
• 1.3 You are not allowed to run IRC/Chat application or any kind of programs or web sites that consume a lot of server resources under our shared hosting environment.
• 1.4 You will not post, link to or transmit any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, blasphemous, profane or otherwise objectionable in any way.
• 1.5 You are not allowed to post, store or transmit illegal files includes Pornography materials (movies, pictures, wallpapers, sound clips), Gambling or Betting materials (scripts or any data), copyrighted Music and Video files (MP3, MTV, Flash, etc.)
• 1.6 Streaming media such as wmv, rm, mp3 or any similar media files are strictly not allowed under shared hosting environment.
• 1.7 Cynet Studio have the right to suspend or terminate accounts or files that is that will cause high server load process. High server load process means data were processed consuming high CPU usage causing server to be slow and causing service downtime to the server.
• 1.8 Any web site especially Forum or Discussion Board web site hosted at our server under a shared hosting environment shall not utilize an unfair amount of the server resources including CPU Usage and Memory. Any forum or discussion board to have more than 20 concurrent user access will be considered as heavy usage and is not allowed to host under our shared hosting. We shall have the right to suspend or terminate the site
• 1.9 Spamming / Mass mailing is strictly not allowed in our shared hosting environment. Sending huge volume of emails can impact the server performance.
• 1.10 While we will use every reasonable endeavor to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorized users or hackers and we shall be under no liability for non-receipt or misrouting of email or for any other failure of email.

2.0 Domain Name Registration Services

• 2.1 Cynet Studio provides Domain Name Registration Services to end-user customers. Cynet Studio do not own domain name registered by our customers.
• 2.2 Customers have the right to change the WHOIS information. If WHOIS changes are not made to show customers actual information, Cynet Studio are not responsible for the domain name and will not be liable for any damages or losses caused by the domain name hosting activities.
• 2.3 All Domain Name Registration is on first come first serve basic, we make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name.
• 2.4 The registration and use of your domain name is subject to the terms and conditions applied by the relevant naming authority; you shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal or failure to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.
• 2.5 You are advised always renew your domain name before the expiry date. Cynet Studio have the right to renew expired domain name that were not renewed by customers upon it's expiry date to sell them at higher price or place for auction.

3.0 Service Termination

• 2.1 If you fail to pay any sums due to us as they fall due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you.
• 2.2 Failure to fully comply with these terms is grounds for account suspension and/or deactivation (with or without refund, subject to Cynet Studio's discretion). Any accounts and/or servers contained within Cynet Studio's network must adhere to the above policies.
• 2.3 We reserve the right to remove any account without prior notice. If we deactivate your account for violating policy, you will forfeit your rights to a refund--and none will be given. No refunds for advanced payment. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.

4.0 Refund

• 4.1 Cynet Studio service are rendered and considered complete after 30 Days from new customer signup. Customers may request for refund if services are not delivered (account is not created) or unsatisfied with the services within 30 Days after payment.
• 4.2 Refund request will not be entertained after 30 Days and also if account were closed/terminated due to abuse issue and regulations above in this policy.
• 4.3 You do agree that domain name registration fees is non refundable.

5.0 Server Outages / Moves

• 5.1 If for any reason we have to move your account from one type of server from another we will make sure you have all of the features on the new server except we reserve the right to not provide the same scripting solutions or database solutions. We reserve the rights to perform the action without written notification in the case of emergency.
